Former Montserrado Rep resists auction decision Print E-mail

An attempt by the Debt Court at the Temple of Justice to auction the properties of former Montserrado Representative Julius Parker has met stiff verbal resistance.
 

The Debt Court’s action is in line with a December 2007 judgment of debt against Mr. Parker’s company, MONCO.
 

According to the court, MONCO owed the Monrovia Oil Trading Company nearly two hundred forty thousand U.S. dollars, which Mr. Parker has since failed to settle.
 

Mr. Parker paid twenty thousand of the amount Friday when he learned the court was about to sell his properties to satisfy the judgment.
 

Frustrated over the Debt Court’s resolve to enforce the action, Mr. Parker engaged Cllr. Johnny Momo, the oil company’s legal representative into a bitter verbal exchange.
 

He accused Cllr. Momo and another representative of the oil company of making fool out of him.
 

The former Montserrado County Representative threatened legal action against anyone who would sell his properties.
 

The properties include three tankers, four houses, a pickup, a gas station and a warehouse.
 

Still at the Temple of Justice, the Criminal Court ‘A’ has denied a motion to dismiss the indictment against Hans Williams and his wife Mardea Payku.
 

Lawyers representing Mr. Williams and his wife wanted the indictment dismissed for state failure to proceed with the case.
 

In a seven-count motion, the defense claimed the state’s failure to try their clients the succeeding term of court violates the criminal procedure law.
 

The in resistance said it could not have started the trial amidst a series of defense motions.
 

Prosecution argued a defense request for an independent autopsy which did not take place on time also delayed the process of indictment.
 

Ruling, Judge Boima Kontoe said the state acted in keeping with law.
 

According to Judge Kontoe, the records show that the state transmitted the case to the circuit in May, thereby meeting its legal obligation.
