State wants Judge Nuta recuse from murder case Print E-mail

Government lawyers have asked Judge Karboi Nuta to recuse himself from presiding over the Kolleh Town massacre case.


Prosecution wants Judge Nuta off the case because he has said that the state has no evidence to link Senator Kaine to the crime.
 

In a motion, prosecution accused Judge Nuta of pre-determining the trial even though it has not presented evidence.
 

The state described Nuta’s September 23rd ruling as confusing and inconsistent with due process.
 

State lawyers claimed the ruling clearly shows that they will not get fair hearing before Criminal Court ‘B’ if Judge Nuta continues with the case.
 

Prosecution’s latest motion follows a notice of assignment for the hearing of Kaine’s application for admission to bail.
 

Judge Nuta granted the motion last week before assigning it for hearing, something, which sparked a serious criticisms against him.
