Judge Nuta denies state motion Print E-mail

Criminal Court ‘B’ Judge Karboi Nuta has denied the state motion to recuse from the case him.
 

Prosecution wanted Judge Nuta to disqualify himself from presiding over the Kolleh Town massacre trial involving Senator Roland Kaine and 15 others.
 

The prosecution accused Judge Nuta of pre-determining the case in an earlier ruling which granted a motion to admit Kaine to bail.
 

Judge Nuta, in the controversial ruling, said he granted the motion because the state did not produce any convincing evidence, even though he has not heard evidence.
 

The state claimed the act destroyed the Judge’s neutrality and impartiality.
 

But Judge Nuta in Wednesday’s ruling claimed he saw no legal reason to submit the request.
 

He said the state provided no laws or statutes to back its request.
 

Judge Nuta has meanwhile assigned the motion to admit Senator Kaine to bail for Friday October 10.
