The much talked about motion to grant detained Senator Roland Kaine to bail has been argued in Criminal Court ‘B’.
Defense lawyer Francis Garlawolo argued the state has failed to link Senator Kaine to the crime in its indictment.
Cllr. Garlawolo said the state also failed to establish the guilt of his client in the indictment.
But prosecution lawyers claimed the court could not grant Kaine bail because the men acted together.
Solicitor General Tiawan Gongloe argued granting Kaine bail would mean nullifying Judge Nuta’s earlier ruling in which he denied separate trial for Kaine.
Closing the state’s argument, Attorney General Philip Banks said the defense request is tantamount to putting the court on trial.
Judge Nuta has reserved ruling on the debated motion.
Margibi Senator Roland Kaine and 15 others were indicted in connection with the murder of more than 14 men.
The incident occurred on June 7 this year in Kolleh Town, Timor District during a dispute over farmland.
Several other people are still believed to be missing from the incident.
