Lawyers representing the Lahai Lasana camp of the Senate have made an application to withdraw from the case.
The lawyers made the application Tuesday morning before the full bench of the Supreme Court.
They claimed they were withdrawing from the case because it was more political than legal.
Nyanabo’s lawyers on the other hand asked the Supreme Court to deny the application because it was only meant to keep the Lahai Lasana leadership in place illegally.
Both sides were expected to argue whether the suspension of Senate Pro Temp Isaac Nyanabo was constitutional or not, when the lawyers announced their withdrawal.
The application shocked many lawyers because there was no prior notice for the action.
The Judicial Canon which governs the conduct of lawyers stipulates when a lawyer can withdraw from a case and when he can not.
Meanwhile, the Supreme Court is expected to pass on the withdrawal application Wednesday morning.
Chief Justice Johnnie Lewis recused himself from the hearing right after representation.
Justice Lewis gave no reason for his recusal.
